Terms of Service
These Terms of Service ("Terms") govern your access to and use of https://preqseal.com and any purchase of oil seals and related sealing products from Monsun (Tianjin) Import and Export Co., Ltd., trading as Preqseal ("we," "us," or "our"). By using the Website or placing an order, you agree to these Terms and the policies incorporated by reference.
These Terms do not exclude or limit consumer rights that cannot lawfully be waived under the laws applicable in the customer's place of residence, including applicable laws in the United States, Vietnam, Thailand, Malaysia, Singapore, and the Philippines.
1. Eligibility, Business Purchases, and Accounts
You must be at least 18 years old, or have the authorization of a parent or legal guardian where permitted by law, to place an order. If you purchase on behalf of a company or other organization, you represent that you have authority to bind that organization. You must provide accurate, current, and complete information and keep any account credentials confidential.
2. Product Information, Selection, and Availability
We make reasonable efforts to display product descriptions, dimensions, materials, specifications, compatibility information, images, and availability accurately. Actual appearance may vary because of screens, lighting, manufacturing tolerances, material variation, or packaging updates. Product-page disclosures, drawings, quotations, instructions, warnings, and confirmed specifications form part of the applicable sales contract.
Oil-seal performance depends on correct product selection and application conditions. Before purchase and installation, you are responsible for verifying the required model, dimensions, shaft and housing tolerances, sealing material, medium, temperature, pressure, rotational speed, lubrication, installation method, and other operating requirements. Any recommendation from us is general unless the relevant application and specification have been confirmed by us in writing.
Products may be discontinued, limited, revised, or unavailable. Placing an order does not guarantee acceptance or availability.
3. Prices, Currency, Taxes, and Errors
Prices are displayed in USD or another currency shown at checkout or in a written quotation. Unless expressly stated otherwise, prices exclude shipping, import duties, taxes, brokerage, remote-area fees, and other charges. You are responsible for charges allocated to you at checkout, in a quotation, or under the applicable shipping term.
We may correct obvious typographical, pricing, inventory, discount, or system errors. If an error affects an accepted order, we will notify you and provide a lawful option to confirm the corrected order or cancel it for a refund.
4. Orders and Contract Formation
Your order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance. We may accept an order when payment is approved and the order is confirmed for fulfillment, or when acceptance is otherwise stated in writing.
We may refuse or cancel an order for lawful reasons, including suspected fraud, payment failure, inaccurate information, stock unavailability, pricing error, purchase-limit violations, restricted destinations, sanctions or export-control concerns, or misuse of promotions. If we cancel after collecting payment, we will issue the appropriate refund.
5. Payment
We accept PayPal and any other payment methods displayed at checkout or confirmed in writing. You authorize us and our payment providers to charge the amount shown at checkout or on the applicable invoice. Payment may be subject to identity, address, fraud, and authorization checks. Your bank or payment provider may charge conversion or transaction fees that we do not control.
6. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy available on the Website and by any transaction-specific quotation, invoice, or shipping term. Delivery dates are estimates unless expressly guaranteed. If we cannot ship within the promised time, we will provide an updated estimate and, where required by law, offer the option to accept the delay or cancel the unshipped order for a prompt refund.
7. Returns, Refunds, and Cancellations
Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy available on the Website. Nothing in that policy limits remedies that are mandatory under applicable consumer law.
8. Product Use, Installation, and Warranty
Products must be selected, handled, stored, installed, maintained, and used only for their intended lawful purpose and in accordance with applicable specifications and instructions. Installation should be performed by qualified personnel where appropriate. We are not responsible for losses caused by incorrect selection, improper installation, incompatible operating conditions, misuse, unauthorized modification, or failure to follow instructions, except to the extent liability cannot lawfully be excluded.
We do not provide an additional commercial warranty unless a specific warranty is stated on the product page, quotation, invoice, or written agreement. This does not reduce statutory guarantees or remedies that cannot lawfully be excluded.
9. Promotions and Discounts
Promotions may be subject to separate eligibility, duration, product, location, quantity, and combination restrictions. Unless required by law, promotional codes have no cash value and may not be sold, transferred, duplicated, or used after expiration. A discounted product is not automatically final sale unless that restriction is clearly disclosed before purchase.
10. Intellectual Property
The Website and its text, graphics, logos, photographs, videos, software, layout, trademarks, technical materials, and other content are owned by or licensed to us and protected by applicable intellectual-property laws. You may use the Website only for personal use or legitimate business purchasing purposes. You may not copy, scrape, reproduce, republish, distribute, modify, reverse engineer, or commercially exploit protected content without permission.
11. Reviews and User Content
If you submit a review, photograph, comment, technical file, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and not misleading, infringing, defamatory, obscene, confidential, or harmful. The Website may rely on or link to third-party payment, shipping, analytics, advertising, social-media, customer-support, or other services. Their separate terms and policies apply. We are not responsible for third-party services to the extent permitted by law, but this does not excuse us from obligations that applicable law places on us as the seller.
14. Disclaimer
Except for express promises and rights that cannot lawfully be excluded, the Website and services are provided on an "as available" basis. We do not guarantee uninterrupted access, error-free operation, or that all Website content will always be complete or current. Product-specific representations are limited to the information confirmed on the product page, checkout, quotation, order confirmation, invoice, or written agreement.
15. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the Website or a purchase. Where liability may lawfully be limited, our aggregate liability relating to an order will not exceed the amount paid for the affected product. These limitations do not apply to fraud, willful misconduct, death or personal injury caused by negligence where liability cannot be excluded, breach of mandatory consumer rights, or any other liability that cannot lawfully be limited.
16. Indemnity
To the extent permitted by law, you agree to indemnify us against third-party claims, losses, and reasonable costs arising from your unlawful use of the Website, violation of these Terms, infringement of another person's rights, or misuse of a product. This section does not apply to the extent a claim was caused by our breach, negligence, or unlawful conduct.
17. International Trade and Import Compliance
You are responsible for providing accurate delivery, customs, tax, and end-use information and for complying with import restrictions applicable to you, except where we expressly agree to act as importer of record or assume a specific obligation. We will not knowingly misdescribe goods, understate value, or evade lawful trade requirements.
18. Governing Law and Disputes
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles, but without excluding mandatory consumer protections that apply in your place of residence. The courts with jurisdiction in Tianjin, China will have non-exclusive jurisdiction over disputes, unless applicable law gives you the right to use another court, regulator, consumer tribunal, chargeback process, mediation service, or dispute-resolution mechanism.
19. Changes, Severability, and Entire Agreement
We may update these Terms for future use of the Website or future orders. The version in effect when an order is accepted normally governs that order unless a change is required by law or agreed in writing. If any provision is unenforceable, the remaining provisions remain in effect. These Terms, the order confirmation, product-page disclosures, quotations, invoices, and incorporated policies form the agreement between you and us for the relevant transaction.
